FPS issues with Shadows of Mordor

So yesterday I had an issue with this game where my fps would drop to 25 - 30 at most. I discovered that rolling back the recent driver update fixed this and I was back to 60 - 70.

SO i booted up windows and went on to try and play, only to discover that I'm back to a jarring >30 fps!

Rig:
i74770k 3.5 GHZ
8GB DDR3 Ram
Nvidia GTX 770 2GB (Watercooled with Corsair Hydro Series H55)

What I've tried so far:
Reset bios to default optimized values
Reset Afterburner (No OC) versus +40MHz on clock (Temp limited to 80*C)
Changing Performance preference in Nvidia Control Panel to "Maximum Preferred"
Turning Vsync off/on INGAME and experimenting with Nvidia Control Panel Vsync settings
Rebooting PC several times
Using Kombustor 2.5 (Sets load to 99% with average fps of 175, temp never reaches above 70*C)
Setting the video resolution option to Boarderless at 100% (1920x1080p)
Changing the graphic settings from Ultra, to Very High and High, with no effect on FPS / GPU power usage.

What I don't get is why throughout the game the GPU is only using between 50 and 55% of its available power?
I just tried running the game without OC, the GPU encounters the same problem with little or no difference in performance than when it is OC.

What do people think?

Lots of people have claimed they can run it at higher texture settings than recommended, then reality sets in.

And the reason it starts out fine then dips is the more Orcs on screen, the more complex textures there are. They really put a lot of detail into the models in this game.

Also, there are no "Very High" settings in this game. It goes from High to Ultra.

My rule of thumb has been to run the benchmark and count on the lowest FPS, which usually occurs when the camera does a ground sweep right by the campfire, being the most stable average FPS you'll get in game, but that's with VSync on.

I can run High textures and everything else maxed, but with no VSync, AA, Blur, or DoF, and average about 90 FPS, but It plays more stable and...

First, check if there is no program that is using high amount of VRAM with program like "ProcessExplorer".
Then, I suggest you try running different texture settings. with 2GB VRAM you should be only able to play on Medium texture quality. High setting requiring 3GB, also Order Independent Transparency uses some good amount of VRAM, while not providing any over the top graphics experience. It makes each chunk of main character's hair to react independently to lighting.

Also, is there any other demanding game that you have that you can test if is using most of the GPU's power?

And the kicker is, I'm hard pressed to even notice any visual difference with these settings.
