How to flash update BIOS? and do i need update?

I have been running intel i7 4790k for 3 days now on my new built PC. I heard that there was something with 4790k and MSI z97 gaming 5 compatability. The question is do i need to update my BIOS? I mean i can access my BIOS and windows runs fine although there are some issues.

-Some programms or games decide not to respond and crash (happened few times)
-I had issues with GTA 4 showing me that i exceed the limit of used memory even though i was 340/3000 and obvioiusly my pc can run it (i fixed it by disabling the auto tune on GTA 4)
-My CPU temperatures are 25 when doing nothing and 30+ when browsing internet and 40+ when gaming and i enabled OC gene and temps are slightly higher
-On task manager it shows that some programms are running on 32 bit even though i have 64 bit PC.

Maybe my CPU is bottlenecking something because i expected temps to get higher on games like AC4 and GTA 4 on absolute max.

Games i tested:
AC4(max)-40 avg(30min/50high) CPU temp-40
GTA (max)-40 avg (30+min/50high)-CPU temp-40
AC3 (max) 60+fps and CPU temp 40
Max payne 3(max) 60+ fps and also CPU temp 40.

System:
GPU: MSi GTX 970
CPU i7 4790k
MoBo: MSi Z97 Gaming 5
Ram: Crucial Ballistix 8gb (green/red LED)
PSU: Corsair AX 860W
SSD: 128 gb Corsair
HHD: 1TB SSHD
OS: Windows 8.1 64bit.

Cant figure out my system yet. Any ideas?
If you suggest something PLEASE explain very step by step.

Programs that are 32 bit will show theyre 32 bit in 64 bit windows. You can install 32 and 64 bit programs in 64 bit windows

A BIOS update wont fix windows / games problems. Update windows / the game/s

A BIOS update may fix the CPU prob

You have no issues, but here's some tips:

1) GTA4 is horribly optimized and runs like CRAP on any PC. I've tested on at least ten different computers (not all mine) from a laptop up to an i7-3770K + GTX680.

The slow-downs and stutter made me give up. I will get GTA5 at some point as it will run great.

2) Since AC3 is working fine your hardware seems to be setup correctly.

3) In the BIOS I suggest setting the CPU to "XMP" and just saving that. It's a default optimization for your CPU and your DDR3 memory so should run your memory at proper speed (i.e. 1600MHz or whatever it is) and your CPU should be about 4.4GHz.

4) run MEMTEST www.memtest.org just to verify no problems with your DDR3 memory (do after any BIOS changes for CPU or memory)

5) update your BIOS if newer exists if you wish. At the very least, go to your motherboard support site and navigate to find out what changes were made in EVERY release since your current BIOS version.

It's generally quite safe now. The major problems are usually fixed right away and as time goes on fixes tend to be minor so after say six months if you have no issues you can probably just leave it.

*BIOS update will set everything back to default.

6) Make sure you have fan control setup for your CPU (possibly case fans) to optimize for noise.

When you say it will set everything to default u mean all the BIOS settings or the PC itself or what?

Also i got fan controller that i use.

But how do i flash the BIOS. Whats the process step by step? I have a Flash drive.

Actually i just tested AC3(max) and it was only 60> FPS. IDK maybe its my GPU.

I cant open MSI gaming app. it says install or update Intel ME driver. Can somebody link me right driver for me to install?

I went on Intel website and found
Intel® ME: Management Engine Driver
Installs the Intel® Management Engine (Intel® ME) version 9.5.15.1730 for Intel® Desktop Boards.
OS: Windows 8.1, 32-bit*, Windows 8.1, 64-bit*

(Latest) Drivers

But there is a version that says 5M. Which one do i choose?

Get it off the MSI site Intel's site is too confusing. That one says for Intel desktops. Yours isnt an Intel desktop

I cant find anything for my MSI motherboard. Unities or drivers doesnt have any Intel ME or anything
