Can you upgrade from windows XP to 8 without losing your data?
This is for my teacher he does not want to back everything up he wants to know if he can just do a transfer of windows and keep his data.

It seems that your teacher's knowledge is misinformed or simply out of date. You can't even upgrade from XP to Win 7 directly.

As I stated earlier, you can upgrade from XP to Vista, then Vista to 7, and then 7 to 8 (three separate upgrades). This would be very inefficient and time consuming. Older applications would likely not make the transition.

So there is no way of overlapping windows XP to 8 then? Can I just deleat the windows folder and then Install the OS or will tat just over write the data that is all ready on?

No, you can't "overlap" or perform an upgrade. It requires a clean install and all previous files will be lost in the process.

Why the reluctance to back up files?

Also, all applications will be lost as well and would have to be re-installed. Some older XP compatible apps will not run on Win 8 and will require separate upgrades (or altogether new applications) as well.

Then, there is the matter of hardware. Can you provide a list of the system components of the rig in question?

Its not my system its my teachers you may not believe this but he is teaching IT yet he knows nothing haa, in our lesson its more like self teaching.
My teacher does not want to back up he thinks that he can just overlay the OS so that's why I made this thread but thankyou for the help I knew that this would not work but i will just tell him to save his data and do a fresh install.

It's at college and I know right he is not a good teacher and every lesson ends up with a argument. Don't ever go to buxton college. Thankd for you help guys.

Direct from MS, upgrade paths for Windows 8:

From XP to 8, "Keep personal files only = Yes". Docs, pics, music, etc.
Note this is NOT 'applications'.
But this is not really recommended. Full reinstall is the way ahead.

However....his XP is almost certainly 32bit. A new Windows 8/8.1 should be a 64bit.
There is no upgrade path for 32bit to 64bit. That MUST be a full reinstall.
