Does warranty gets void by using a third party software on my own to recover data?

No, I don't think so. The drive was theoretically faulty before you used whatever to recover your data.

And the warranty has nothing to do with your data...only possibly replacing the physical drive.

What USAFRet (+^1) is true! It wouldn't void the warranty to try recovering the data at your own risk.
I say at your own risk, because it is possible to corrupt the data even more.
Western Digital won't hold you responsible for that, nor will we recover the data.
