I got an email from the seller saying that the broken plastic part he was talking about on the auction was actually him trimming the plastic overhang to fit his mid case. He says it works fine but I am afraid he voided the warranty. Should I go for it? The card it self and fans look fine

I would not buy that card for that price. Like buzz said, $80 would be a good MAX.
The owner obviously did not know what he was doing. Brings the care and use of the card into question.

It's a common thing to do on large cards like that (For people who don't know how to check dimensions). It will not effect the performance of the card.
What warranty are you talking about? It's a three year old card. There is no warranty.

And what is the price you're paying...? You can get a used 280x (Newer version of that card) for like $160 on amazon. And the purchase from amazon would actually have a warranty.
