New build won't get past "Windows Files are loading" and only sometimes gets past Bios

Hey guys, need some help here. So I just built a budget build its rocking a GTX 760, FX-8350 and Gigabyte 990FXA-UD3, Corsair CS750M, 8gb Crucial Ram, 256GB SSD.

Here is the problem I cannot get past the " Windows files are loading" when trying to install windows 7, when trying to install windows 8 I would get a blue screen. I replaced the memory with a known good kit, reseated the CPU, checked everything and I still get the same problem. My CPU worked in a Sabertooth 990FX that had to be RMA'd but ASUS wouldn't fix. However it does not work in the new build. I'm not sure if it is the Motherboard or CPU because the CPU did spend about 3 weeks on my desk.

I tried with a single ram stick in all of the slots had the same effect. My first guess was the ram since it would post and go into bios. However after the initial post it would have trouble getting into the bios. I bought a FX-6300 on sale and will try with that, worst that can happen is I eBay it.
