Issues with ASUS Radeon R9 270X DirectCU II TOP OC graphics card

I just bought this card and put together my computer I can post a complete build if required.
My problem was the flickering issue a number of people have had I flashed the bios and it hasn't flickered since, however I've only used it for about 2 hours since then.
THE MAIN ISSUE is the memory clock seems to max out for no reason at idle, while I have built a lot of computers for friend I don't actually know much about graphics cards and how they "should run"
Can provide pics of the GPU Tweak program showing the spikes.

The Dual x is a great card, and sapphire has much better costumer service, Although it is clocked slower, it is still pretty powerful and seems to be a bit more reliable than the direct cuII model which has lately been under a fair amount of criticism.
That is a bit odd, is it just spikes? or consistent 100% load, because little spikes happen and there is nothing to do. I am questioning the Bios flashing part, as that may be the source of prolonged 100% at idle, however if it is jut little spikes that last for a few seconds, I would think little of it. Could you show the pics of the load spikes?

Yeah here is some images it appears to be doing better since this last restart... Maybe I am just over reacting to the screen flicker and it being my first big (to me computer build).

There is a screen shot of about 30 seconds worth of monitoring it's peaking about once every 30sec - minute. At idle, light web browsing didn't seem to make it much worse.
 
I can not tell the exact duration of those spikes, but they seem to be under a second, or right around one, how often do they happen? My card puts out much smaller spikes rather often, about ten times an hour, and that seems pretty normal, as long as these spikes are not happening once a minute, I think there is no problem.

I will keep monitoring but they are about a sec or less lasting but probably up to 60 an hour. HOWEVER i haven't monitor for an hour period since my "fixes" will post again in about an hour with more info.
 
The only thing I can think, is that there is sometehing wrong with that bios, if so you can try to switch back then you may fix the black screen, but then the flickering may return, the best thing to do would have been to contact the manufacture the second you were getting flickers, as now that you have bios flashed, they may not accept an RMA either way, contact them. And also, do you have this card over or under clocked? that could cause the black screens.

I did call that's what the rep from ASUS suggested I do. I also learned ASUS has some horrible customer service. I bought it through amazon and can still return thinking I will go ahead and do that. No over or under clocking done by me.
