Buying from Newegg VS New on Ebay

So, I found the Gigabyte Windforce R9 270 on Ebay for 130 dollars, and it is the cheapest one that is new. Should I buy from there, or get it for around 160 on Newegg?

I have a PSU thats in its box and original packaging, never opened, still counts as new.
I could drop it several times on the floor and still call it new.

But it's listed as new, not used. Does that still apply? If so, why? Not trying to say you're wrong, just want to have a explanation. Specifically, what issues?
