CPU temperature to high?

So I have been using the Scythe Mugen 4 PCGH and when doing nothing the temperture was 22-30, well one of the fans did't work so it might have been even cooler if both fans were working.
anyway so I have sent my cooler back for reparation and decided to use the stock cooler.
But now I'm getting 40 degrees Celsius when doing nothing and when doing a torture test with P95 the temperture rised to 80+ degrees within a minute(so i stopped the test).

So is the stock cooler really that bad, or do I have a bad CPU?
I remember getting 76 degrees when overclocking to 4,4 Ghz with the mugen 4 PCGH which I thought was a bit to high because I heard people overclocking it to 4,5-5 Ghz.

That's a pretty quick conclusion. Don't you think we should ask about the OP's overclocking? You know, Vcore, the testing he did, what procedure he followed? I don't think the cooler is the problem.

Right now running on 3,5 GHz with turbo on(3,9 GHz) and Vcore = 1V.
My Scythe Muggen 4 PCGH is on RMA, so I won't buy a new cooler just because the stock cooler is to bad.

So you're not overclocking and you've already RMA'd the Scythe. Did you just stop overclocking? Because in a previous post you were at 4.4. What temperatures were you getting idle and load?

When I had my Scythe Mugen PCGH just 1 of the 2 fans worked.
But I tried overlocking it to 4,4 GHz.
When idle I got about 25 degrees, and on full load about 70-75 degrees.

So technically, the CPU temps are a little high where throttling may occur. While it's quite possible the cooler was bad, to me it's a little more about inexperience with overclocking. Please don't take that personal. Did you reapply the thermal paste when placing the old cooler back on? You should have. Auto Vcore is ok but it tends to overvolt the CPU thus increasing the temperature.

Couple things to know. There is not a single CPU that is the same. Just because someone was able to get to 4.5 on air with the same CPU doesn't mean you will. It's a lottery. You may be able to go higher or not even reach the same level. I also don't believe that someone was able to overclock to 5 GHz on air. That's pretty tough and usually requires a custom water loop.

Well, I got my Mugen 4 PCGH back, and used 1 fan, to see what temperatures I would get running at 4Ghz with 1V.

I cleaned the CPU & reapplied the thermal paste.
