Corsair Vengeance 8GB Kit rated at 1600MHZ showing at 1333MHZ

Just got some extra ram as it was cheaper than normal on Amazon and I popped it in and it shows that it's running at 1333MHZ and not 1600MHZ as it is rated on the box & stickers on the Ram.

XMP is disabled to get it running as if XMP Is on with all 4 chips in the system fails to boot BUT with the 2 new chips on there own it boots with XMP but only still rated at 1333MHZ

This is a bit of a weird one should I just return the Ram to Amazon? Here is the system with all 4 chips in but if i select XMP it fails to boot so i have to have it set to disabled which means the 2 old chips run at 1600MHZ but the new 2 chips run at 1333MHZ

Specs:
Asus Z87-K MB with latest Bios from Asus
i5 4670k running at stock

Any ideads?

Yeah I googled the issue and saw those 2 threads, Setting it manually still sets it to 1333 and not 1600, im in an amazon live chat now to get the ram replaced but well its not going so well atm as it was a "marketplace" seller and not direct amazon so they can't just reship another item >.>

Just an update on this I have spoke to amazon and i have another kit coming out and a refund coming ... maybe its some duff or miss rated ram but this dont fill me with hope http://i.imgur.com/ZO4OzmK.jpg that is the new chips in on there own, they run at xpm on there own but still with a base of 1333 and not 1600 as they should have as the box an amazon said

we can change in bios if it shows again the same MHZ it definitely the processor generations problem,
1600 mhz & higher mhz ram works correctly in 3 rd gen processors & higher gen and shows less mhz in 2nd gen processors
