Can I upgrade from Windows 7 OEM to Windows 8.1 retail?

Hello, I built a gaming PC a few months ago with Windows 7 OEM, however I recently found out that doing that is illegal. There is nothing I can do about it now, but I can make things right. My question is: if I buy and install Windows 8.1 retail on my Windows 7 OEM computer, will the Windows 7 OEM license remain, or will the Windows 8.1 retail license overwrite it?

AFAIK, using Win 7 is not illegal, as long as you paid for it. The limitation is that you cannot reuse an OEM disk on another system down the road. As long as your copy of Windows activated, you are fine by Microsoft.

There is no no need to change to Win 8, as users of Win 7 (as well as Win 8) will all have the choice to be upgraded at no cost to Win 10 in the months ahead.

I was under the impression that using Windows 7 OEM for personal use was agents Microsoft's terms of use. Did they change it?

Clear as mud. I have built personal systems and used Windows OEM, and not had any issues.
