Will my friend be able to get a free upgrade to windows 10?

My friend said he had the pirated version of windows 8.1 and he said he activated so it made it genuine. I told him to check if he could upgrade via the icon in the corner and he said it wasn't there. My friend keeps arguing with me and saying he can upgrade when it's not there. Will he be able to upgrade or will he have to buy it?

Doesn't matter if that notification icon exists or not.
Pirated OS = no.

While it 'may' upgrade to Windows 10, it will still remain a pirated OS. It doesn't automagically become legit.
