FX-8350 running hot with a Hyper 212 Evo?

Just got this cpu about a week ago and it runs hotter then my old 6300, I grabbed a 212 seeing as that is what most recommend for air coolers. I played games like Diablo 3, CS:GO, Watched Twitch steams, and other general computer stuff.

When playing CS:GO and Diablo 3 the temps are around 45-55C and once it sits at 50-55C for a couple of mins it will start to thermal throttle and my FPS decreases significantly (CS:GO goes from about 250 to 15), I also like to watch twitch steams while I play and when running a stream and the games the temps stay about the same but the thermal throttling gets worse.

The fan is in a push config and pushes out to the back of my case to an exhaust fan, everything seems to be mounted correctly and I applied a pea sized amount of thermal paste. Is there anything I can do?

NZXT H440 w/stock fans (1 rear exhaust, 3 front fans)
Fx-8350 stock speeds
Asrock 970 extreme3 R2.0
Corsair Vengeance Blue 8gb
PNY Gtx 770 2gb
1tb HDD
128gb SSD

I have CPU Temp running all the time on my second monitor and it NEVER goes above 55C and still thermal throttles? I know that this temp is not too bad but it is still throttling.

I suspect your motherboard is the problem. Your VCore looks low, and your frequency should be 4.1 ghz at 20.5 ratio. From ASRock (for FX CPU's): For cooling the CPU and its surrounding components, please install a CPU cooler with a top-down blowing design. It's likely the motherboard VRM's are overheating.

Are you using the same motherboard you had used with the FX6300? Did you reset the BIOS after you installed the 8350? If not, you should.

Yes I am using the same mobo, I did not reset the bios. So could you recommend a cooler? I dont really want to use the stock one and I have already purchased two different coolers?
