3770k z77 multiplier change isn't increasing clock speed

I have a GIGABYTE GA-Z77X-UD4H LGA 1155 Intel Z77 with a 3770k cpu. I am trying to overclock it (have had it as stock for a long time). I have turned off turbo, and go to increase the multiplier. I bump it up to 40 but it reads as only 3.5ghz (cpu id and bios). Doesn't appear to increase the multiplier ? What am I doing wrong? It's acting like it won't let me change the multiplier? Well this is annoying. I reset the bios and it'll boot at 3.5 ghz with 3.9 turbo. Verified under cpu id. I change the multiplier to 40 and it work- verified under cpu id. But now it I go to change the mutliplier from 40 to 41 it won't change. Still shows 40 under cpu id. It is saving the changed value, but not really changing it. So some bios changes will take, but others won't. Is my motherboard bad somehow?
