cpu is not oc by core speed is rising

i just built my new pc
processor i7 4790k, mobo asrock fatality z97x killer and i'm using the stock coolers which i got with my processor.
i'm noob at this kind of things.
i haven't done oc but my processor core speed it hitting up to 4359.7 mhz and getting a lot of heat while playing games, but in uefi setting turbo core speed it at 4000 mhz and target core speed at 4000mhz but still the core speed is increasing when ever i run heavy software's or games

There's absolutely nothing wrong; the turbo speed is 4.4 GHz and it runs at that frequency only when a couple cores are very busy. If you run Prime95 26.6 (don't use version 28.5 or newer with the stock cooler) Small FFTs, then it will run at 4 GHZ. If you select only one or two threads, then it will run at 4.4 GHz.
If will run at 4.0 GHz when enough cores are busy, but it will reach 4.4 GHz when only one core is busy. The clock is 99 MHz instead 100 MHz; that's why you get 4.36 GHz instead of 4.4 GHz. Now could you tell us what you mean by a lot of heat and what is the ambient temperature?

i didn't overclocked it but its reach upto 4.4 ghz even when there is no work going in background, i use speecy to check the temperatue of the processor and other parts. when i run the intel extreme tuning utility, according to it the processor cache ratio and core ratios are overlocked. But in uefi utility target clock is set to 4.0Ghz. i want know where the fault is going on???
