How is Nvidia getting AMD's HBM? Isn't HBM exculsive to AMD?

Hey guys u all know that Nvidia's upcoming Pascal Gpus will be using HBM, so if HBM is AMD's technology how is Nvidia getting HBM? isn't it supppose to be exculsive to AMD ?

AMD helped Hynix develop HBM but they do not own the patents. Also, Hynix is supposedly giving AMD priority over Nvidia on HBM and HMB2 when Nvidia starts shipping Pascal GPUs. http://wccftech.com/amd-working-entire-range-hbm-gpus-follow-fiji-fury-lineup/
 


The caveat to this is that Samsung is also manufacturing HBM2, so whilst AMD will get exclusivity with Hynix, nVidia will probably just go with Sammy instead :p

That would make sense since there are also rumors of Nvidia contracting Sammy to make chips for them and the HBM is basically part of the GPU chip although they are separate dies. It would definitely streamline things if Sammy made both the core and the VRAM for them at the same time in the same place. It isn't clear if those will be desktop GPU chips, though, but it would be interesting. I wonder how AMD is doing it right now with Hynix and TSMC. I'm guessing AMD has to buy up a bunch of HBM and then send them over to TSMC to slap onto the Fiji chips which, now that I think about it, could account for the steep pricing of these cards.
