Bios update error with nodusm3-gl8e (5.07 update)

Im updating my bios from 3.04 to 3.10 or 5.07 (its the same)
im running Win 8.1
when i run the update it says system does not meet minimum requirements 9996
the update was made for xp and vista not win7+
is there anyway of getting round this
