I have a dell laptop having windows 7 home premium OEM. Can I upgrade it to Windows 10 and thus get a retail licence so that I may use it on a different PC??

Solution

You understand wrong. OEM keys on new motherboards are written into the BIOS, they still exist and ARE OEM. When you upgrade to Windows 10 you do NOT get a new license, you only carry over activation!

In simple words, you cannot use your license on another machine. Even if you have a retail Windows 7 license you cannot install Windows 10 that was upgraded...

Thanks for the fast reply. But I am still not convinced. You said my product key will be superceded by windows 10. So I will still be getting a product key for windows 10.... right??
If I understand correctly from windows 8.1 onwards OEM is abandoned. That means I will be getting a windows 10 retail version. Why cant I use it for the new machine??

In simple words, you cannot use your license on another machine. Even if you have a retail Windows 7 license you cannot install Windows 10 that was upgraded using that license on any other computer. You must first delete Windows 7 and 10 (upgraded from that license) from all computers before installing either on a new one.

Thanks...
But what puzzles me is that I had my motherboard replaced by dell after an accident... Its been 2 years and the old os is working fine on the new motherboard.
BUT if you ask me whether the service dudes contacted MS for doing this.... I dont know... as I gave them laptop for almost 2 weeks for the repair works.
(I am sure that I got a new motherboard I checked....)

That's an entirely separate issue. You still have just one OEM license, which means you need to buy a new license for your new computer. There is nothing you can do to change that fact.

You're also talking about the mobo changeout when it was Win7, which means the underside had the original MS Win7 Code sticker on the bottom. With that being the case anyone who repaired your computer would have been able to install 7 fresh and use the key on the underside of the laptop or on the desktop they usually apply a sticker on the case somewhere near the back. It's once you upgrade to 8 or above that the code becomes hardwired to the mobo, which to me seems silly because what happens if the mobo dies and you replace it, simple, you must talk with a MS customer service person and explain the hardware change, at which time they'll re-assign the key from the old dead mobo to your current install. But they won't let it activate on two at the same time. Can't blame them really, it's just an anti-piracy move but you know the adage, build a better way of doing something and someone will find a loophole to them make you improve again. It's like anti-virus software, it's useless without updates to keep up with the newer and better virus.
