USB 3.0 HDD same speed on USB 2 and USB 3. WHY?

Toshiba Basics 2TB External USB 3.0 5400RPM Hard Drive.
Bought a few days back. No other problems at all.

I get the same speed, 25-28MB/s on my USB 2.0 ports and USB 3.0 ports.
They are wired up correctly

Thoughts?
I don't want to request a replacement or claim warranty, unless really required as I need my hard drive for the next few days.

Isn't that devious marketing? I'm copying videos and photographs, I imagined at least 50-60. Pity
How would I go about updating my USB drivers? I've never had to do that
 
I wouldn't enable write caching on an external drive - it leaves too much margin for file loss & partition table errors if theres sudden power loss.

What os are you running??

I'll say now I use teracopy personally, its free & seems to offer better sustained copying/moving speeds between devices & also file pause/resume options.

Free software ,no ads or junk , easily settable as main copying process in any windows version, easy to disable/re-enable.

May make no difference but there's no reason not to try it.
