Did the whole 970 memory debacle and EVGA 970 cooler issue get cleared up?

So now tis the season for all the big releases and many eyes are looking for shiny new upgrades. The 970 seems a no-brainer, but looking for 'round up' and comparison articles turns up little recent work but worryingly there doesn't seem to be a neato resolve for the EVGA issue - the memory one, seems to have been cleared up enough - but am I missing something there?

Are EVGA 970's good to grab now or just avoid and go MSI/Gigabtye?

Solution
cooler =yes memory =no all 970's are still 3.5 any brand

the evga acx2.0+ is the coolers on them now if not its a old stock or old revision card [04G-P4-''3''975 the 3 shows it the 3ed revision] 2 is older 1 means reference

if unsure about the evga the MSi would be my next choice

Well, the memory issue is never going to change, it's hardware, so unless they released a 970 r2 or something it'll never change. I was in the same position as you up until the 390 got released, Which in my opinion is a much better choice. You get for the same price, 8gb of VRAM, and generally they're slightly less expensive for near enough the same performance, with the 390 more often than not outperforming the 970

its not 100% but a good indicator of evga cards why not look at there 980 hybrid ?? is a true NVidia card where the 970 is not ??

http://www.evga.com/Products/Product.aspx?pn=04G-P4-1989-KR

''Furthermore, as we mentioned in our GTX 980 review, GTX 970 has been a pure virtual (no reference card) launch, which means all of NVIDIA’s partners are launching their custom cards right out of the gate. A lot of these have been recycled or otherwise only slightly modified GTX 700/600 series designs, ''

the 970 looks like all the junk that did not make a true 980 and just slapped together to sell something that would of went in to the trash ??
