Buying from USA is not worth it. If you were to ship it new, you'll pay higher prices than what you'll pay locally. Also, if you were to trick customs by telling your relatives to send you an open-box card(people try to do it), you'll have a voided warranty, and possible penalty.

Unless you get an absolutely killer deal, buying from abroad is slower and dearer.

3.5gb of the vram runs at the full rated speed, but once a game starts to utilize more than 3.5gb it switches to slower VRAM.

So the card effectively has 3.5gb of good vram. Which is still PLENTY for 1080p max settings.

Its up to you, the 970 is more powerful, do you feel like your game experience is lacking? and is it worth the money to improve it?

I would go for te 390 personally before the 970, make sure your PSU is at least 600 watts.

One thing to note is that the r9 390 will cost you more in power but if you buy it right now, the cheapest model is 20$ less than the cheapest 970

So in the long run if you use it many hours a day for years it may cost you a bit more than a 970 but it is worth it for the power of the GPU IMO.
 
970 and 390 are more or less the same performance and price in the US and the 390, while consuming more power, has 8 gigabytes of GDDR5 RAM.

However, by your username, you could be from India, where there's a difference of 10000 INR. The 390 is not worth that difference.
