Is my temp safe? 4770k with 212evo

soo i my cpu 4770k is getting too hot. im using a 212 evo and my motherboard is a gigabyte z97 d3h.. i wanted to know if these temps are safe..
47c at ideal
95 at gaming , such as gta 5
and 100 during a cpu z stress
also, the tip of my heat sync is a bit cut.. is that a issue? i just cut a little, and i think the inside is a bit visable... the hole is reallly small but is visable... i also recently got a new case , corsair air 540 but that 3 fans that came with it and the open sapce is not helping me at all... please help...
 
Solution
Your temps are too high and you are thermal throttling. If the cut is causing the HS to not sit flat, there's your problem. They are cheap enough to replace.

The EVO, while a decent HSF, isn't all that great for i7's at high clocks. At least I found the 212 EVO was 10C hotter than my Silver Arrow setup with a i7 5820K @ 4.4Ghz. The EVO allowed up to 80C during RealBench stress test, and the Silver Arrow only allowed it to get to 70C. That is with 1.25v.
