Gtx 960 Hard Freeze, But Sound Keeps Playing Normally/540 mhz Lock

My 960 is acting weird for the last few days.

Randomly, it would freeze while in game and wont move.
The sound keeps playing normally, but nothing moves, works, or does anything.
Alt+Tab won't work, Ctrl+Alt+Delete, won't work, Ctrl+Shift+Esc won't work.
The only thing that works is a reset on the system.

Another problem is that the game, benchmark, and other things pause and start playing back in low fps.
I go into Msi Afterburner, and see that the graphics card is running at 539/540 mhz.
I have to restart for this problem to go away.

For both these problems, i have contacted Nvidia separately on each matter, RMAed it, Clean installed the drivers, cleared Cmos, took out everything that was not needed, reinstalled geforce experience, underclocking, not overclocking, and overclocking both the cpu and gpu, and tried changing the graphics settings in all games and benchmarks.
My 560ti forks great without any problems though.

CPU: Pentium g3258 @ 4.4ghz (stable)
GPU: Gigabyte G1 Gaming GTX 960 4gb
Motherboard: Asrock z97
Ram: 4gb (I know it sucks)
CPU cooler: Hyper 212 Evo
SSD: OCZ Trion 100 240gb
Case: Nzxt s340
PSU: Corsair cx600

I think you need to contact gigabyte directly first for their instructions. And you can also ask help from where you buy the card if they can offer any assistance to you.

I have not tried it in another computer because I dont have one

I will try the Bios update.

It is on the latest drivers and how do you rma a gpu that's over the 30 day time period?
