Hi guys. cant decide between the two my system for reference is:
cpu - i5 6500 skylake
gpu - gtx 750 ti
ram - 8gb ddr4
psu - seasonic 620w
hdd - 1tb WD caviar blue

the gpu i'm eyeing is gtx 970 (I know, I know the 3.5gb scam nvidia pulled off)but I still have doubts with r9 390 or in AMD in general especially with the whole crimson fiasco. (I came from hd6770 before the switch to 750ti)

the ssd I want is bx100 250gb or samsung 850 250gb evo
I'm currently playing AC: Syndicate and GTA V in high settings with 35-40 fps on AC and 45-60 fps on GTA.

Solution
Get the GPU. The SSD is nice, but all that's going to do is give you fast boot times and load faster. You will should see a huge difference with the GTX 970.

Crimson Fiasco?

My system.

FX 8120-Overclocked to 4ghz
Radeon 7950 3gb
8gb ddr3
EVGA 600B
240gb corsair neutron ssd
640gb hard drive for storage(need to swap for the 1tb at my desk)

I previously had a radeon 7850 2gb which from what I read, performance wise, was about the same as your 750ti. Not a bad card. But I got a good deal on a used 7950. 120 bucks for a 7950, hard to pass up, even sold my 7850 at the time for 50 bucks. From what research I've done, the 7950 is not far below an r9 380, which give or take equals a gtx 960.

That said, I saw a nice improvement...

That said, I saw a nice improvement on my framerates and the amount of details I could run. For you, you've already got a stronger processor than I do. A GTX 970 should be just fine. I was just looking online about the crimson thing, and so that looks concerning no doubt, I've been running an older version of the drivers, so I guess I've not been affected by it. Another reason to hold out I suppose.

Google sometime about nvidia gameworks though. But that said, as long as the drivers are good, either the AMD card or the nvidia card should make you happy.

Do you have a Microcenter near you? If so, might I suggest buying there? If you purchase their 2 year replacement, then if say in a year, if you do have trouble, take the part back and they fix or replace it.

In either case, the graphics card is your best bet. The SSD can be picked up for about 60-70 for a 240gb, so I think those will likely keep coming down.
