looking for a $400-ish gaming pc build

Budget Range: would love to come in at or below $400 if possible

System Usage from Most to Least Important: gaming pc

Are you buying a monitor: No, i have a 43" hd tv that i am going to use

Parts to Upgrade: everything, i have nothing to start with

Do you need to buy OS: No, i have a new win 7 64bit disk i'm going to use

Location: new orleans, la, usa

Parts Preferences: i normally use intel and nvidia but have used amd in the past occasionally. if it helps stay within budget, i'll use anything.

Overclocking: no

SLI or Crossfire: no

Your Monitor Resolution: 43" jvc brand hdmi tv (just purchased new this past christmas)

Additional Comments: this is going to be used as a secondary gaming pc for when my friend comes over to do side-by-side co-op or multi-player games. i have a primary game pc already, so i don't need to break the bank on this one. as long as i can do 1080p resolution at medium settings and get close to 30fps, i'm good with that.

my old sony vaio laptop (intel core i7-2630qm 2.0 ghz and nvidia geforce gt 540m) just does't cut it anymore. example, for "sniper elite v2" i have to run with everything at lowest possible settings and at 800x600 just to get a playable framerate, and that was probably around 10 fps. similar situation for "sniper elite 3", and "splinter cell conviction" was running at less then 10 fps, it was unplayable.

for comparison, my primary machine has an intel core i5-4670k @ 3.4 ghz with a geforce gtx 770 and i am more than happy with it's performance on anything i've tried playing. so this new build needs to be better than my sony laptop but doesn't have to be as good as my primary.

And Most Importantly, Why Are You Upgrading: see above comment.

First 2 will give you medium or high detail and 30-60FPS in most games at 1080P Last cheapest will be medium detail at 30-60FPS.

Anyway adding cheap CPU cooler or even old AM3 box cooler for 125W CPUs will be enough to OC this CPU around 4.2- 4.4Ghz
but this also required reuse fan from 860k box cooler to cool down VRM on Mobo :)
