i have a AMD phenom ii x4 965 with stock heat sink and when i started to watch a show the fan slowly got louder and louder and i checked and it was over 5000rpm the pc was under 20% load at 41c normally the fan you cant hear it but it sounded like someone had a vacuum running
why could this be? (as of now typing this the fan has slowed back down to normal but goes up when i start the show back up...)

Solution
If your case has lower air flow the fans built in temperature sensor will speed it up(higher case temperature causes this).

The fan kind of has a mind of its own because it gets motherboard speed request, but can get even faster from its temperature sensor.

If you have room for an extra case fan it may be an idea to move some more air in the system.

Many users go with aftermarket coolers to avoid this issue.

im probably gonna get one ive just built this pc from old parts from my gaming pc and i just use it as a htpc, the cpu fan never really gets to loud because i never really load it with much stress but ill look into a aftermarket cooler and im gonna get some sound dampening foam for in the case to also help with noise levels
