i5 3570K with hyper 103 over 40 degrees idle

So I am running my 3570K at stock, with the turbo enabled.
I just put in the hyper 103, with the thermal paste that was in the box, so maybe that was not the best quality product. I am using realtemp, and at the moment of writing this my coldest core is 36 degrees, and the hottest is 44.

As i understand it these should be somewhat lower with this cooler.
While gaming I did not see it go past 75 maybe 78 at the most, but I heard people saying they do not go over 50-55. I also heard that my idle should be more like in the low 30s, or high 20s without OC.
I am quite sure, that my fan does not run on max when not under load, cause it is quite silent on idle, and this is how i like it, to be honest.

Also my case is an Aerocool Battlehawk
It's a little bit on the smaller, more cramped size, but it has two fans.

I looked at pictures of this cooler and I have seen it installed with the fans facing the RAM modules, and also the opposite way, it facing the rear of the case. I put mine in facing the RAM, but looking at the cooler I don't see a reason for it to mean a difference.

Do you think there is something to be done with these temps?

Not the greatest temps, but nothing wrong with them ;) COuld try pulling the cooler and reinstalling with new thermal compound, if there's a relatively thick amount on the CPU and/or cooler you had used too much

Actually that is pretty hot for gaming which generally is not that stressfull on the CPU. My 3770 never got that hot and I only used stock cooling. You could try a prime95 stress test, but keep an eye on it and if it goes over 80 stop the test (not sure the actual limit for a 3570K but I don't like temps over 80 myself).

Are you sure you've got the cooler mounted correctly and have applied the paste properly? There are many useful videos on youtube that show you how if you are not sure.
 
It throttles at 100°C and nothing bad will happen if it gets that hot (though it shouldn't be run like that for hours).

Thank you for your answer (and also for everyone else :))
So I was looking at it today, and the temps are actually lower, but not by much.
Yesterday i looked at them maybe too shortly after gaming, because now looking at it my hottest core is switching between 38-40 degrees.
The only reason this bothered me was because with this cooler I thought I should get better results, and i suppose it is true, but also these temps are not in any way harmful to my cpu, so for now i guess i will live with it.
After 2 hours of Rise of the Tomb Raider, my cpu temps actually did not reach 70, so not sure why I remembered close to 80 degrees. It might have been that I was remembering what I got with the stock cooler.

Anyway, the temps should be lower with this cooler, but they are not in any way harmful to my system, so because I don't really plan to OC it right now, I think I wont mess with it anymore.

I think I should get better results with reapplying the thermal paste, but I decided not to mess with it for now.
My temps are somewhat lower, than I believed yesterday (see my other answer), and I will watch it under load, but right now it actually does not reach 70, so I decided not to worry about it.

Also in my bios (asrock z68pro3gen3) for some reason I can't put the cpu target temp under 45 degrees, maybe that is the reason why my cooler let it get to high 30s or low 40s. It's obvious, that it does not work at full capacity in idle, but it's okay, because I like that it is so silent. So long story short, I decided that things are okay for now. Thank you for your help!
 
While it isn't very busy in the BIOS, it isn't idle; it can be idle only once the OS is loaded. Why not use Intel XTU to monitor your CPU? Set it for up to one hour and then you can see the maximum temperature or what it was at any time by hovering over a specific part of the graph.
