Memory question on android

I bought a tablet that advertises 8gb of memory but new out of box shows 2.5GB free only, is this false advertising? can I sue them for selling me goods under pretence of having 8GB of storage. When I rang them they tell me the operating system takes up half and that's why I don't see 8GB but internal memory only shows 3.5GB total memory, as you would see if it was 4GB. It has Android Lollypop 5.1 installed. I have installed 4 apps, biggest 300mb and only have 300mb left.

I have googled the size and ranging from 200-300mb upto 5GB so not sure what it should be

8 GB is the storage but android takes aproximately 4 Gigs,so basicall you cant do anything to them,the application might need more space this is true,the only thing you can do is to buy an external sd card

Sticker on front says 8GB Go but another email Hipstreet states " Hi John, here is the other explanation that we received from our head office: that data - pictures, videos, music and documents are different than apps. Data can be stored on the external, but apps need to be on the internal or main ram to work correctly. also some apps say 20-80MB, but the additional space could require 250MB"

I emailed them screen captures but they still think it has 8GB

Would upload but no option showing only if they are already online, which I have no online storage

Thanks guys. Got fed up, installed 4 apps and had full memory so erased and took back to store. VERY misleading as only 2.3GB usable user space. Got money back so will have to wait for decent one when I have more money. IT would'nt let you transfer apps to the 32GB I had put in it.
