Its old.
The price is higher because of people like you. You have an old motherboard and want to upgrade just the processor. Retailers are more willing to gouge you than sell it for cheaper.
(You also shouldnt be looking at a 4770k its either a 4790k or preferably a 6700k)

I wouldn't expect to buy one "new" because they've been out of production for several years.
$265 isn't too bad:
