Ok got a laptop with a 320GB internal HDD and I'm running DBAN and everything is working fine its just that it lists my HDD as having 298GB? Is this normal? I'm sitting here thinking that its going to leave 22GB unwiped which is a security risk, I dont know whats going on?

That is correct. Basically it comes down to marketing, the company will always say 320GB! instead of 'around 300GB formatted'. This is because of differences in measurements. Without going into any detail, 1 gigabyte on a hard disk is 1000 megabytes to the manufacturers. Over here in reality, it is actually 1024 megabytes.

Here is something I found that goes into detail on why this is: https://www.quora.com/Is-1-GB-equal-to-1024-MB-or-1000-MB
No. The tool is not leaving 22 GB. There are no 22 GB of free storage as your HDD is not 320 GB but 298GB. So, the tool wipes the whole drive and the data would be unrecoverable.

Let's suppose you get a 1 TB drive. Actually, this drive has 931.30 GB of storage space and the tool would show you that.
