Gigabyte Mobo Windows 7 Install Problems

I'm having problems installing fresh windows 7 on my new pc. I changed the boot order from Hard Drive to CDROM first, and it still won't allow me to install the fresh copy of windows, it just loads my old copy. I tried putting a brand new hard drive in and it just gave me and ERROR and told me to INSERT DISC AND PRESS ENTER and nothing would happen. I can't get windows 7 to properly install on this GIGABYTE MOBO. Could someone help me out pleasE!

The Regular Windows works fine when I use the regular hard drive that was in the machine (as in it boots normally with the already installed windows), but when I put any other hard drive or SSD into the machine it will say the error that I had listed above. Also when I put windows in on the old HD it doesn't give me an option to reformat / install or anything just boots straight through

1. I put a bootable windows 7 home premium disc into the machine
2. It just starts the machine like normal doesn't allow me to press any button
3. When I put the disc in with the new HD / SSD it will just give me the error.

It's not allowing me to install windows is the problem.

Make sure in the BIOS that you have legacy boot turned on, and that legacy boot to CD is active and first, assuming that your mobo has a UEFI BIOS that can switch from the UEFI boot to legacy/compatibility. What is the mobo, so we can check that?

I think I found the problem out, I looked under my System and noticed that my CD / DVD drive wasn't appearing could that be the problem, but it still opens and closes
