ASUS Maximus VIII Hero quality control issues?

I just purchased this new Asus motherboard and at first inspection I've seen a lot of scratches on the heatsink of the motherboard. Should i get a replacement for it or keep it this way? Also, the box was not sealed and didn't have any marks left by a seal.
Any answer is apprecated.

Boards boxes are not sealed (at least, I've never received a sealed one).
As for scratches, if they bother you, then yes, RMA it. Otherwise, I suggest testing it and, if working, keeping it.

Motherboards are not sealed. If I were you, I'd test out the motherboard to see if it works. It's up to you if you want to return it since you said it is scratched.
