in game vsync wont lock fps

okay so i know dying light is an old game but i just recently reinstalled the game again and i cant get my vsync to lock my fps to my selected refresh rate. now i seen other threads say theirs locked at 30 fps, but mines actually doing the opposite. my display is set at 1080p 60hz (which i checked to make sure the refresh rate was set at 60hz) but in game i will be getting anywhere from 85-105 fps in game with vsync on. now that would generally be good but im rockin a 4k
VIZIO D40u-D1 40-inch 4k Ultra HD Smart TV so i dont have gsync... so basically gameplay is choppy. also I went to the nvidia control panel and selected vsync on, adaptive, and fast and none seem to help except maybe adaptive a little bit. any ideas on what i can do? maybe change something in the user settings? help is much appreciated.

Don't even use the in game vsync on Dying Light, because it's horribly unoptimized, and doesn't really stop screen tear.

I run the game with no vsync, as the screen tear is so small and infrequent. You can however force it externally through your GPU panel though.

If you find it runs visually well enough without vsync, you can cap framerate with RTSS, which is the lowest such tool in RAM usage.
