I5 3570k or Haswell I5?

So right now I have an I3 4170 with my GTX 970, because of this I wana upgrade my CPU. So my options are get this CPU/MOBO combo for 150$ shipped including an I5 3570k and a 50$ MOBO. With my Hyper t2 I can maybe overclock the I5 to around 3.8-4.0ghz. My second option is to pay 200$ for a Haswell I5 (note my I3 goes to my brother for free in both situations so no leveraging that). What are your thoughts on what choice I should go for? (note I don't remember the chipset for the LGA 1155 board I just remember it can overclock my I5 as stated.)
 
It would help to know for sure what motherboard it is. You'd likely need a better cooler for overclocking, the t2 is a low end cooler. Hardwaresecrets tested it with an i5 2500k oc'd to only 4ghz. At 24c ambient air temp (75F) the t2 was only able to keep the cores at 92c while running p95 small fft's. Other coolers like the phanteks tc12dx managed at 25c ambient to keep the cores at 74c, much more respectable under the same p95 stress tests.

I'm sure it was a fine cooler for a locked i3, slightly better than a stock cooler. Not really suitable for overclocking an i5 though. At the very minimum for a mild to moderate overclock something like a hyper 212 evo or cryorig h7 would be much better. That aside the 3570k should do fine for the next couple of years if oc'd to help make up the difference in performance compared to newer gen cpu's. It's not a whole lot slower than a 4670k or 4690k but it is 4yrs old.

Update: if the 4460 is the haswell alternative, I'd opt for the 3570k, get a decent cooler and oc it. Newer isn't always better unless there's an option on the newer haswell motherboard you want/need. Hard to compare a previous gen top of the line i5 to one gen newer but bottom of the barrel i5. An oc'd 3570k will stomp on a stock 4460 all day long.
