How can you check whether a gpu is NEW or USED

I am in the market for buying a new GPU. This guy is selling a 980ti, but he has no warranty. He says it is brand new. I do not trust him at all. He offered a good price though. Is there a way to check if a GPU is new? Bios or something? Need fast assistance.

He took it out of the box but left it in the foil supposedly. The box does seem a little damaged at the ends of it. So there is no way of telling? What about through some sort of serial number?
 
Box should be sealed if it's "brand new" (this applies in all but very few cases), and the anti-static bag should also be sealed. Other than that, dust in the heatsink and the fans should be a good indicator of how used it is since I doubt he'd bother to clean it well enough for it to appear entirely brand new (for example, dust in the corner where the fan blades connect to the fan hub should be a good indicator of whether or not it's used as it's more difficult to clean out from there).

But I mean I have put my 970 back in the seal, and the box and it looks brand new. I'm very doubtful. Thanks for the tips. Any more? I mean how come there is no way to go into bios and see if the card has been powered up?
