I am transferring my cpu (intel i3 540) form my old motherboard (MSI H55M-P33) to my new motherboard (GIGABYTE H110M-S2H-GSM) and the 2 pins on the sides dont align! does this mean i need another motherboard or my CPU is outdated?

Solution
You don't want to put an old CPU in a new motherboard or you will risk bending the pins on that thing. You will definitely need to buy a new CPU.

If it doesn't fit then yes, you will need a new CPU or motherboard depending on which you want to keep. DO NOT try and force it on the socket. This is why you should always make sure there's no compatibility issues before making a purchase. You can use This to check most components.

You need a motherboard from when that CPU was in production, that has an LGA 1156 socket. The motherboards that are compatible -- though always check the manufacturer before purchasing -- will have H55, P55, H57, or Q57 in the name. The motherboard you purchased is for Skylake and upcoming CPUs and is the third new mainstream socket since your socket was used. They are incompatible.
