Seeing as how the seller has a decent 89% rating, I wouldn't be worried about if its a scam. Safety and performance wise, CPU's don't tend to have problems when you buy them used, as any previous damage to them would show severe and very clear problems in the computer (if it even turns on). I bought my two 8-core Xeon E5-2670's from Ebay, used, for $60 each and they work perfectly. The only thing that could happen is that the seller buys the processors bulk, keeps the best-performing ones and sells the slower ones used, so you might not get a fast one, but if you really want a 4770k and don't see the price getting any lower than that, you should buy it.
