Low FPS FX-8370 CPU?

My specs:
CPU: AMD-FX 8370 4.2GHz (slightly OC)
CPU Cooler: Gammax 300
Motherboard: Socket AM3+ - AMD 760G - GA-78LMT-USB3 (rev. 4.1)
Ram: 16GB Ram (2 8GB cards)
HDD/monitor: 1TB HDD - 144Hz acer Monitor
GPU: KFA2 Nvidia Gefore GTX 1070
PSU: 650W Corsair Power supply

Ingame, for example black ops 3, if I set all settings to LOWEST possible, I get 70-90 fps. When I set them all to MAX I get exactly the same FPS. Im pretty sure the problem is not my 1070, but my FX 8370 CPU.is there any way to fix this? Im using it with 4.2GHz and Turbo core. in less CPU demanding games like Overwatch, I get 120-140 fps

If you can change your settings like that and the framerate doesn't change, that is an indication of the CPU limiting you. The 1070 is a powerful card. For the kinds of games/settings/resolution/framerates it's intended, you need a much more powerful CPU.

The throttling idea is worth checking out. If you monitor your clockspeeds, with MSI Afterburner or similar, while gaming, are your CPU clockspeeds up where they should be and stable?

anything I can do about this except for new Mobo + CPU...?

The FX series is seriously behind modern Intels/Ryzen and you're going to frequently run into a lot of trouble pushing a 125W CPU on a low-end motherboard. The CPU isn't worth spending on another motherboard; your next motherboard purchase should be for a CPU on a modern platform.
