Gpu crash in specific game

Purchased a new gpu recently, EVGA 980Ti Kingpin and its been having a problem since I bought it. Recently it was crashing every game I had until I installed EVGA XOC Precision, all games seemed stable except for Skyrim SE for some reason.

The crash involves my screen going either, white, light blue, light pink, or red, and then after a few seconds of looped distorted noise from whatever game I'm playing it comes up with "no signal" for both monitors. I previously had this issue for all games even when I installed XOC, until I tried having it open on my 2nd monitor and then all of the games I tested weren't crashing anymore and were playing fine (GTA5, Witcher 3, PUBG, Fallout 4). I tried skyrim SSE again, but it was still crashing even though none of my other games were. The crashes I was getting when XOC was not installed/opened are the exact same ones I am getting for Skyrim SE, so I believe it might be the problem. And I find it hard to believe that I NEED XOC open whenever I'm playing a game for it not to crash.

I've tried taking out 2 sticks of ram, rolling back drivers 3 times using DDU, uninstalling XOC and using MSI after burner, which made every game crash like before. I'm thinking its software related that's causing the crashes and I have no idea what to do, and my gpu is not oc'd. Temps are always under 65c and the right side panel of the case is off so it shouldn't be any overheating or airflow problem.

I bet he knowingly sold you a bad card. If I were you I would get my money back. If you cant then try threatening him either verbally or even better... Physically.

The thing is I didn't change anything that would stop the games from crashing, all I did was add a custom fan curve and change the leds from breathing to static. Thats literally all I did, they guy I bought the card from told me you need the software opened or minimized in order for it to run games which I thought was surprising. All games started to work except Skyrim SE, I'm coming to a conclusion that its a bug in EVGA Precision XOC and DX12 games since SSE is the only game I ran that was DX12 and is STILL having the same crashes as when I didn't have the software opened at all.
