How to know if you got a ES Xeon?

I recently bought a Intel Xeon E5-2697 v3, which was supposed to be a QS version.
But in Cpu-Z it shows up as ES, is it still considered a QS? or shall I complain to my seller?

What you have is an Engineering Sample. Chances are it passed inspection so they sent it out to the retailer as a QS. If it works ok I would not worry about it. It is however not what you paid for. That may be reason enough to send it back.

I should add however that many ES chips that are released are actually better then retail versions since they have been cherry picked.
