Can I put a Intel I5 4590 right out of the box in a GigaByte GA-B85M-D3V (Rev. 2.0) without any previous BIOS updates? I went on pcpartpicker and there was a warning saying that the motherboard may need a previous BIOS update.

i5-4590 is a haswell refresh CPU so it needs a bios update for it to post at all. There are also two revisions of the board but I don't think Gigabyte released a board with the bios updated for haswell. I'm not familiar with GA boards, I know ASUS has a sticker at the top stating what bios it's on out of the box, then from there look it up on their site and match it to the minimum bios version required for said CPU.

So after a little bit of search I came across the ASRock H81 Pro BTC R2.0 Intel H81 SK1150 and I've seen a lot of people say you can use a I5 4590 right out of the box , but im not 100% sure about this so I'd like your opinion please.

Yep! Supports haswell refresh out of the box. Here is the support list that says since bios "ALL"
