WIN 7 Pro MAR licence issue

Hi!

I'd like to ask your help about the following PC return procedure.
I recently purchased a 6 years old used IBM ThinkStation S20 for $215 with WIN 7 blue COA and "new" Refurbished licence label from an auction site similar to eBay.The seller installed the operating system on the HDD himself and included the "installation disc" which was a copy on a DVD...
The PC turned out to be defective so I did contact the seller to return it.
He was willing to refund some of the money but wanted to deduct the cost of the licence which
cost him $65 for the following reason.
He said that the Refurbished licence label was brand new and the PC is part of IBM MAR program,
Also,he would take it back for full price if the licence would be original without new separate Refurbished licence but I'm the 1st user of a brand new licence.
He suggested that I can remove the label/licence if I wanted and use it for other PC.
(which by the way illegal and would be kinda physically impossible)
Unfortunately,I do not have the knowledge to decide whether he has the right to withhold the licence fee but I feel he only wants to rip me off...

Could you help me to find a lawful answer for this particular case please?

The license is not tied to you, it is tied to the computer. I don't know what would be legal or not in your area, but since the license is tied to the computer and the computer is bad, it should be up to the seller to figure out what to do with the license.
