Without RAM you get beep code meaning 'no RAM" as expected (https://www.asus.com/support/FAQ/1029959/#). So you either have problem with RAM stick or with motherboard slots. Try the stick in other slots first and see if it helps. If it does, it means one (or more) of motherboard slots is faulty. If no change, then probably the RAM is faulty (but it could also be a problem with CPU).

If this is a new build, it would need a BIOS update to support that CPU

And the only way you can update is either use a Skylake CPU that the BIOS supports.

Or take it to a shop and ask them to flash the BIOS with a Skylake CPU first

It would need BIOS 3016 to support that Kaby Lake CPU

Core i5-7400 (3.0GHz, 4C, L3:6M, Intel HD 600 series, 65W, rev.B0) ALL 3016

Look at the sticker on the mobo. If the last 4 numbers arent 3016 or higher, then it needs a BIOS update

I've tried the same stick of RAM in all four slots so either the RAM is faulty or the CPU is then

I had a disk that came with the mobo which im guessing has the drivers on there, would i be able to do anything with that before asking around to flash the BIOS or is it necessary for the pc to boot?

As far as I know, if the problem lies in incorrect BIOS version, most boards will power cycle - turn on for about 30 seconds then power down, then repeat. Although it is possible this one does that differently. So it is quite possible you have two separate problems - wrong BIOS and faulty RAM stick. But of course updating BIOS (if the sticker shows it's wrong version) is the first thing to do - and only if that won't solve problem, you have to look about RAM problem.

As a side note, it's been a year since a BIOS updates for KabyLake has been issued. I'm quite surprised if a new board still has older version.

So could i send the mobo back to asus and ask them to flash the bios for me?

You could ask them, and I think they could agree. But - considering possible shipping fees and time required, you may as well look for a local comp shop that can probably do it for same money and faster.
