Error Code 38 & Frame Loss Just Cause 3

I recently purchased Just Cause 3, it handled fine for the first few weeks. I have been able to play the game at 1440p and best settings at above 60 fps. After a week or so, the game started to crash and give me the Error Code 38. I have looked up how to fix the error, but nothing has worked.The solution I found to work was to turn all the settings down to 1080p with all other settings at low or off. The problem I then ran into was, that after 10 to 20 minutes of me playing the game my frame rate would drop drastically to around 10-40 fps. I am not sure why this is happening but it has made the game unplayable.

GPU: GTX 1080
CPU: Intel Core i7 4790K
RAM: 16 Gigabytes
Storage: Samsung 850 EVO 500 GB
Motherboard: ASUS B85M-g R2.0

I remember when the game first came out, there was an nvidia glitch that just about everyone was having. A few weeks later nVidia released an updated driver that resolved the issue. Since then, I've installed on the game on multiple systems and have not had any issues. Have you done a clean install of the latest nVidia drivers? Is Just Cause 3 up-to-date on patches?

I have reinstalled all my drivers and checked if the game is up to date on patches, still the same conclusion.
