My hdd is failing and Im buying a new one.
Does anybody know how I could avoid buying another windows OS for my new hard drive?

I had windows 8 installed at first but had upgraded with the free windows 10 update a while back.
The computer itself can boot up but is unusable as far as programs go, therefore downloading and using any software on it is gonna be impossible.
I don't have the original installation disk or product key.

Reinstalling Win 10 on a new drive in the same system is no problem.
You're only changing the drive.

You will, however, need a working PC to create the USB install needed to install Win 10. "Impossible" or no, this is required.

Simply put the new drive in, boot from the install media you created (DVD or USB), and install.
How to do a CLEAN installation of Windows 10
