BF3 Low fps

So I just got a new video card (5870) and for some reason I'm still getting low fps in game (about 30)

This is the setup I have:

i5 2500k
4gb ram
500gb HDD
700W PSU

Please help, I want to play this game but for some reason it isnt work.. I haven't checked other games but I will do that soon

what settings are you running the game at? Resolution and Quality?

I get about the same fps on all settings and Im running the game at 1080p

mostly play the game on medium though

Update,

So I figured out that if I restart my computer and then start BF3 imminently, I get 80 fps... odd that I would have to restart the whole computer to play a game and another thing, When I start the game for the first time in a few hours it wont launch, I will get a Bf3 has crash or something from windows and then but after I "X" out of that and start it again (joining the same server) it works... HELP
