Intel Modem Problems

Having real trouble with an Intel chipset modem made by Mentor the ambient internal 56k v92 pci control less hardware model. What happens is I install the modem and everything is ok setup completes and I can surf the net.
Then after 2 weeks it has stopped working I rang the place of purchase they said oh yes Bios settings mate its your on board modem disable it then it works I checked this setting it was disabled or the modem I have wouldnt have worked in the first place. The bios has not been changed or any windows settings.
When I try to get on line there is a click from the modem then error no dial tone.
Lines ok as my other computer with a different modem in works.
Swapped faulty modem into another computer wont work in that computer. Computer detects and setsup the modem it just wont dial just clicks once then dialer error no dial tone.
Any suggestions would be much appreciated cheers
