this is true by the way!
we lost a samsung phone a couple of months ago - went through that
horrible process of getting a new phone through the insurance and
whatever the fee was 75$ ? We got the same exact one.
Anyway...today my wife found the phone under the seat of the car! The
question is can I use this phone or if I try to activate it will the
serial come up and I'll be accused of scamming the insurance which I
didn't.
I'm due for a new phone anyway but so it's not a big deal but as long
as it's sitting there I was wondering if I could use it. I have one of
those horrible Moto 720's and wouldn't mind

Technically, when insurance pays off on a total loss claim and the
property is later recovered, they own the recovered property. I'd
call VZW and/or the insurance company, tell them what happened, and
see if you can make some arrangements for keeping the phone (if you
want to). Be up front about it and no one will be able to claim you

thanks sounds like a good idea. last thing I need is insurance problems
over a phone that would cost me 50 bucks!

Your "safest" route it to contact the insurance carrier. Advise that you
found the phone. That should be enough. If they want it back, they'll send
you a mailer. That takes care of the insurance part.
Now: if you can keep the phone (which is more than likely) you now call
verizon asking them to verify that the phone (esn) is not on any hot sheet
or stolen list (because perhaps you reported it lost/stolen earlier) If so,
have it removed, as you are the previous phone owner. You now have a backup
phone; although not by plan, it is still a back up phone. It wasn't free,
it cost you $50 and you used up one of your two annual claims if it is
lockline. dr

Get their response in hard copy. Failing that follow up with a letter over
your sig on what you understand from any phone conversations. Make lots of
notes.
