is this graphics card damaged?

I've bought a Radeon 9800 Pro from eBay and the display it produces
is 'broken'.

The card came with an Arctic Cooling VGA Silencer and my feeling is
that this card has been damaged from overclocking.

Before I confront the seller, I'd be grateful for anyone's opinion
on this issue.
