I have been into PPC's for a few years now and have lots of software I
bought for my arm machines but which I do not use any more. Most of it
downloaded from Handango. I would like to sell it on as second-hand stuff.
How do I go about this? Thanks for us.

It's a gray area... Most software developers give you the right to use the
software. This right is not transferable. So, even if sell the software and
destroy your copy, the transfer would not be legal.

I think some developers do it to avoid an after market that would exclude
them from the selling to new users. Pretty normal these days.

In short. Read the Licence Agreement. If it doesn't say anything then you
might have the right to sell it. Otherwise, nope.

Yes, but you have to take a look at the Softman v. Adobe case where a
reseller un-bundled Adobe software and sold it separately. The court
there denied Adobe's request for injunction under the doctrine of
first sale. This doctrine provides, in part, the following (from the
court case):

"The first sale doctrine vests the copy owner with statutory
privileges under the Act which operate as limits on the exclusive
rights of the copyright owners."

The first sale doctrine allows the original purchaser of a copy to
resell that copy without consideration of any limitations on the
product, including issues related to licensing. Now, after the first
sale, you do enter the gray area.

To resell the software, you should probably look into eBay or other
forums.

Good luck.

Paul
